January: Book Chapter on Capital Markets Law and Social Media
Philipp Maume, ‘Capital Markets Regulation in the Age of Social Media: An Analysis of the GameStop Incident under the EU Market Abuse Regulation’, in: Lee/Darbellay (Hrsg.), A Research Agenda for Financial Law and Regulation (Edward Elgar, 2025)
It does not always have to be crypto - social media in general comes up with very interesting (and challenging!) issues. For example, the GameStop incident highlightet the impact that small investors can have if they team up. But was that (or: would that have been) market abuse under EU laws? Do these ‘swarms’ operate under the same rules and principles as the ‘informed investor’ in traditional capital markets regulation? Do regulators have to keep an eye on social media? And if so, who should do it? Many questions, and not many answers yet.
